Reservations

• Reservations may be made through our website, email, WhatsApp, telephone, or authorized booking partners.
• A reservation is confirmed only after payment (full or partial) has been received and a confirmation has been issued.
• Prices are listed in U.S. Dollars (USD) unless otherwise indicated.

Payments

• We accept payment through our online booking platform and other approved payment methods.
• Full payment may be required at the time of booking unless otherwise agreed.
• All applicable taxes and fees are included or disclosed before payment.

Cancellation Policy

Unless otherwise stated for a specific activity:

• Cancellations made 48 hours or more before the scheduled activity receive a full refund.
• Cancellations made within 48 hours of the activity are non-refundable.
• No-shows are non-refundable.
• Refunds are processed using the original payment method.

Certain promotions, private tours, or group bookings may have different cancellation policies, which will be communicated during booking.

Weather Policy

Monteverde experiences frequent rain and changing weather conditions.

Activities operate rain or shine unless El Tesoro determines conditions are unsafe.

If El Tesoro cancels an activity due to weather or safety concerns, guests may choose between:

• Rescheduling (subject to availability), or
• Receiving a full refund.

Weather conditions that guests personally find undesirable do not qualify for refunds.

Schedule Changes

• Guests should arrive at least 15 minutes before the scheduled departure.
• Late arrivals may result in reduced activity time or cancellation without refund.

El Tesoro reserves the right to modify routes, schedules, or itineraries due to:

• Weather
• Trail conditions
• Safety concerns
• Operational requirements
• Force majeure events

Participation Requirements

Participants are responsible for ensuring they are physically able to participate.

Guests should inform us before the activity if they have:

• Heart conditions
• Serious back or neck problems
• Recent surgeries
• Pregnancy
• Mobility limitations
• Any medical condition that could affect participation

El Tesoro reserves the right to refuse participation if a guide believes participation could endanger the guest, staff, animals, or other participants.

Horseback Riding

For horseback riding activities:

• Riders must follow all guide instructions.
• Horses are assigned based on experience, size, and availability.
• Riding outside designated areas is prohibited.
• Excessive speed or reckless riding is not permitted.
• Helmets are recommended whenever available.
• Guests may be required to disclose their approximate weight so an appropriate horse can be assigned.

ATV and Other Motorized Activities

Drivers must:

• Meet the minimum legal age requirements.
• Possess a valid driver's license when required.
• Follow all safety instructions.
• Operate vehicles responsibly.

Guests are responsible for damages resulting from reckless, negligent, or unauthorized operation.

Safety

Safety is our highest priority.

Guests agree to:

• Follow guide instructions at all times.
• Use provided safety equipment properly.
• Respect wildlife and the environment.
• Refrain from participating while under the influence of alcohol or drugs.

Failure to comply may result in immediate removal from the activity without refund.

Assumption of Risk

Outdoor adventure activities involve inherent risks, including but not limited to:

• Falls
• Animal behavior
• Uneven terrain
• Weather conditions
• Equipment failure
• Natural hazards

By participating, guests voluntarily accept these inherent risks.

Limitation of Liability

To the fullest extent permitted by law, El Tesoro shall not be liable for:

• Personal injury arising from inherent risks of outdoor activities
• Loss, theft, or damage to personal belongings
• Delays caused by weather, road conditions, or circumstances beyond our control
• Acts of third-party transportation providers or suppliers

Nothing in these Terms limits liability where prohibited by applicable law.

Personal Belongings

• Guests are responsible for their own belongings.
• We recommend leaving valuables in a secure location.
• El Tesoro is not responsible for lost, stolen, or damaged personal property.

Photography

During activities, photographs or videos may be taken.

Unless you notify us otherwise, you grant El Tesoro permission to use photographs or videos in which you appear for promotional and marketing purposes.

Guests wishing to opt out should notify staff before the activity begins.

All website content, including:

• Text
• Images
• Logos
• Videos
• Graphics

is the property of El Tesoro unless otherwise stated and may not be copied or reproduced without written permission.

Pricing

Prices are subject to change without prior notice.

However, confirmed reservations will honor the price paid at the time of booking.

Force Majeure

El Tesoro shall not be responsible for delays, cancellations, or inability to perform services resulting from circumstances beyond our reasonable control, including but not limited to:

• Natural disasters
• Severe weather
• Government actions
• Road closures
• Pandemics
• Civil disturbances
• Utility failures

Privacy

Personal information collected during booking is used solely to:

• Process reservations
• Communicate with guests
• Improve our services
• Meet legal obligations

We do not sell personal information to third parties.

Governing Law

These Terms and Conditions shall be governed by the laws of the Republic of Costa Rica.

Any disputes shall be subject to the jurisdiction of the competent courts of Costa Rica.
